SO YOU RECEIVED A STATEMENT OF CLAIM?
Here's the One Thing You Need to Do
A lender may file a Statement of Claim against a borrower if they are noted in default. Usually this means a borrower has failed to make scheduled payments but it could also be triggered by a breach in the mortgage agreement (ex. failure to insure the property, failure to pay condo fees or property tax, or allowing the property to incur significant loss of value).Â
Once received, you have 20 days to respond to the notice by filing a Statement of Defence or a Demand for Notice. Be advised there is no defence against non-payment of mortgage so in most cases, a Demand for Notice is the best response.Â
This declares that the defendant wishes to be kept up-to-date on the legal proceedings. If no response has been filed, the court may find the defendant in default and rule in favor of the plaintiff.
